These Terms and Conditions apply to all contracts, deliveries, and other services provided by coldrock.games e.U. (hereinafter "Provider"). The contracting party is coldrock.games e.U., Karl-Beck-Gasse 5/1, 1220 Vienna, Austria.
The presentation of products (software, courses, digital goods) on the website does not constitute a legally binding offer, but an invitation to order. By completing the ordering process, the customer submits a binding offer. The contract is only concluded upon our written order confirmation or by the provision of the service (e.g., download link, activation).
All prices quoted are in Euro and are final prices (in accordance with the small business regulation ยง 6 Para. 1 Item 27 UStG, no sales tax is shown unless otherwise stated). Payments are due immediately upon invoicing without deduction.
4.1 Usage: The provider grants the customer a simple, non-transferable right to use the acquired digital content for personal use. Any commercial use, reproduction, or distribution to third parties is prohibited without express written consent.
4.2 Fair Play & Anti-Cheat: The use of auxiliary programs (hacks, cheats, bots, scripts) that manipulate gameplay or provide unfair advantages is strictly prohibited. Attacks on the server infrastructure (e.g., DDoS), reverse engineering, or manipulation of communication between client and server are also prohibited.
4.3 Sanctions & License Revocation: In the event of a violation of the Fair Play rules or attacks on the system, the provider is entitled to block access (ban) temporarily or permanently. In the event of serious or repeated violations, the right to use the software expires immediately without any claim to a refund of payments already made.
In the case of contracts for digital content not delivered on a physical data carrier, the right of withdrawal expires prematurely if the customer has expressly agreed to the execution of the contract before the end of the withdrawal period and has confirmed awareness that they lose their right of withdrawal by giving their consent.
The provider is liable without limitation for damages resulting from injury to life, body, or health. For other damages, the provider is only liable in cases of intent or gross negligence. The warranty is governed by the statutory provisions.
The provider strives for high availability of the online services (website, server). However, 100% availability cannot be guaranteed. Maintenance work, security updates, or unforeseen events may lead to temporary downtime. This does not result in any claims for compensation.
Austrian law applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). If the customer is a merchant, the place of jurisdiction is Vienna. Should individual provisions of these TAC be ineffective, the remainder of the contract remains effective.
